Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Muhammad Hassaan Sarfraz, a sole trader (enskild firma) trading as "Watzup" ("we", "us"). By creating an account, accepting these Terms at sign-up, or using the service, you agree to them. If you accept on behalf of a company, you confirm you are authorised to bind it.

Watzup is a software platform that helps businesses communicate with their customers over the WhatsApp Business Platform — including automated bots and flows, a shared inbox, broadcasts, message templates, contact management and optional AI-assisted replies. The service depends on third-party platforms (notably Meta/WhatsApp and Stripe) whose availability and rules are outside our control.

  • You must provide accurate, current information and keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account; enable two-factor authentication where possible.
  • You are responsible for your team members’ use of the account.
  • Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Subscriptions renew automatically until cancelled.
  • Free trials (where offered) need no payment card and never turn into a paid plan by themselves. When a trial ends, the account becomes read-only — no messages are sent from it — until you choose a paid plan.
  • Fees are exclusive of taxes; you are responsible for applicable VAT/taxes, and for providing a valid VAT number where relevant.
  • If a payment fails, we may retry and may suspend or limit the account until payment is made.
  • Except where required by law, fees are non-refundable. You can cancel at any time; cancellation takes effect at the end of the current billing period.

You must use Watzup lawfully and in compliance with the WhatsApp Business Messaging Policy, WhatsApp Business Terms and Meta’s policies. You must not:

  • send messages without the recipient’s required opt-in/consent, or send spam or unsolicited bulk messages;
  • send unlawful, infringing, deceptive, harassing or harmful content;
  • attempt to breach security, disrupt the service, or access other tenants’ data;
  • misuse the AI features or reverse-engineer the platform.

Violating WhatsApp/Meta policies can result in your WhatsApp number being restricted by Meta — which is outside our control.

You retain ownership of the data you put into the platform. For personal data about your end-customers, you are the data controller and Watzup is your processor; that processing is governed by our Data Processing Agreement at watzup.se/dpa, which forms part of these Terms and is incorporated by reference. You are responsible for having a lawful basis and any necessary consents to message your contacts. Our handling of your own account data is described in our Privacy Policy.

We (and our licensors) own all rights in the Watzup platform, software and brand. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You own your content and data.

We may suspend or terminate access for breach of these Terms, non-payment, or violation of WhatsApp/Meta policies or applicable law, or where required to protect the service or other users. You may stop using and cancel the service at any time. On termination, data is handled as described in the DPA and Privacy Policy.

The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not guarantee uninterrupted or error-free operation, or the availability of third-party platforms such as WhatsApp. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

These Terms are governed by the laws of Sweden, and the courts of Sweden have exclusive jurisdiction, without prejudice to mandatory consumer or data-protection rights.

We may update these Terms from time to time. We will notify you of material changes in-app or by email; continued use after changes take effect constitutes acceptance.
